This Privacy Policy explains how ShiftScale Digital LLC ("ShiftScale," "we," "us," or "our") collects, uses, discloses, and safeguards information in connection with the ShiftScale Digital marketing agency services, the ShiftScale CRM platform, our website at shiftscaledigital.com, and related services (collectively, the "Services").
By using the Services, you agree to this Privacy Policy. If you do not agree, do not use the Services.
1. Who this policy covers
This policy addresses three kinds of individuals:
- Customer personnel — staff at businesses that engage ShiftScale for marketing or platform services.
- End consumers — a Customer's own customers and prospects whose information is processed through the Services on the Customer's behalf.
- Website visitors — anyone who visits our public website.
For consumer information processed on a Customer's behalf, the Customer is the controller of that information and is responsible for having appropriate rights, notices, and consents. ShiftScale acts as a service provider / processor and only processes that information to provide the Services under our agreement with the Customer.
2. Information we collect
a. Information you provide. Account and contact details (name, business email, phone), business information, billing and payment details, support communications, and content you submit.
b. Consumer information processed on a Customer's behalf. To deliver the Services, we process consumer records supplied by the Customer or drawn, with the Customer's authorization, from the Customer's connected systems. This may include contact details, appointment records, communications history, service history, and campaign engagement data.
c. Information from connected systems. With the Customer's authorization, we access data from third-party CRM, calendar, ad platform, and analytics systems. We access only data fields necessary to provide the Services, and use it solely for that Customer. We do not sell it or use it for our own independent purposes. d. Information collected automatically. Device and usage data, log data, IP address, and cookie data when you visit our website (see our Cookie Policy).
We do not knowingly collect information from children under 13 (or under 16 where applicable). The Services are for business use and are not directed to children.
3. How we use information
- Provide, operate, maintain, and improve the Services;
- Authenticate users and secure accounts;
- Process transactions and send related administrative communications;
- Deliver, route, and analyze communications (calls, texts, emails, chat) that a Customer sends to consumers through the Services;
- Generate reporting and analytics for the Customer;
- Provide customer support;
- Detect, prevent, and address fraud, abuse, security, and technical issues; and
- Comply with legal obligations and enforce our agreements.
4. How we share information
- With service providers / sub-processors that perform functions on our behalf — cloud hosting, communications infrastructure, ad platforms, payment processing, analytics. These providers are bound by confidentiality and data-protection obligations.
- With connected systems, at the Customer's direction.
- With the applicable Customer, whose consumer data we process.
- For legal reasons — to comply with law, enforce our terms, or protect rights.
- In a business transfer — subject to this policy.
We do not sell personal information and do not "share" it for cross-context behavioral advertising under applicable U.S. state privacy laws.
5. Communications, calls, and text messages
The Services enable Customers to communicate with consumers by phone, text, email, and chat. Calls and messages may be recorded, transcribed, and analyzed to provide and improve the Services, subject to the Customer's notices and consents. See our SMS / Text Messaging Terms.
6. Data retention
We retain information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Consumer information processed on a Customer's behalf is retained per our agreement with that Customer and deleted or returned on termination, subject to legal retention requirements and routine backups.
7. Security
We maintain administrative, technical, and organizational safeguards including encryption in transit and at rest, role-based access controls, per-Customer data isolation, and hosting with reputable U.S. infrastructure providers. See our Data Processing & Security page.
8. Your choices and rights
- Website visitors and Customer personnel: contact us at support@shiftscaledigital.com to exercise available rights.
- Consumers whose information is processed on a Customer's behalf should direct requests to the Customer; where we receive such a request directly, we refer it to that Customer.
We will not discriminate against you for exercising your rights.
9. U.S. state privacy disclosures
Where applicable state laws grant rights, ShiftScale honors those rights as described above. We do not sell personal information or share it for cross-context behavioral advertising.
10. International users
The Services operate in the United States and are intended for U.S.-based businesses. If you access the Services from outside the U.S., you understand information is processed in the U.S.
11. Third-party links
The Services may link to third-party websites we do not control. Their practices are governed by their own policies.
12. Changes to this policy
We may update this Privacy Policy. Material changes will be indicated by updating the "Last updated" date. Continued use after changes take effect constitutes acceptance.
